New Delhi: Supreme Court on Wednesday transferred all the present and future FIRs against BJP’s suspended spokesperson Nupur Sharma over her remarks on Prophet to Delhi Police.
The apex court also gave her liberty to approach Delhi HC for quashing etc.
Additionally, the court also turned down the plea of West Bengal for a Court-monitored joint SIT probe.
A special bench of Justices Surya Kant and Pardiwala in its order said, "The telecast dated 26 may 2022, on a tv channel "Times Now" has led to registration of various FIRs and complaints against the petitioner in different parts of the country. Though the petitioner was initially on 1st July relegated to avail the alternative remedy with reference to her first prayer for quashing FIR, however, in light of subsequent events highlighted by her with respect to grave and imminent threat to her life.
“We are of the view that a part of cause of action has arise in Delhi and she is at liberty to move the Delhi High Court for quashing the FIR and the FIR which may be registered against her in future.
“We direct that all the FIRs be transferred and clubbed for the purpose of investigation to Delhi Police. The Delhi Police shall ensure that the first FIR (of Maharashtra) along with FIR dated 8 June are investigated together by clubbing the other FIRs in different parts.
“Whether or not a SIT is to be constituted for the investigation, IFSO of Delhi Police appears to be a specialized agency and it will be appreciated it the investigation is done by it. The IFSO will be at liberty to collect information from other states for it to reach a logical conclusion.
“Till such time investigation is completed, the interim order dated July 19 shall continue. The order dated 1st July stands modified,” the bench said.
